The Crown has admitted numerous breaches of the Treaty of Waitangi against Te Tai Tokerau Maori ahead of the country's largest Waitangi Tribunal settlement, which could be worth up to $1 billion.
Crown draft concessions for the Waitangi Tribunal's Te Papa o Te Raki inquiry into Northland Treaty settlement claims acknowledge many Treaty breaches around the region.
But the Crown wants to see the tribunal complete its report on the first stage of the inquiry before moving into the second phase of its hearing of hundreds of Treaty grievances filed by Ngapuhi and other northern Maori.
Ngapuhi hapu and claimants feel the same way. During a tribunal judicial conference at Waitangi last week, they emphasised the tribunal's report on its Stage One hearings dealing with He Whakaputanga (the 1835 Declaration of Independence) and the 1840 Te Tiriti o Waitangi was necessary before starting the Stage Two hearings, hopefully in February next year.
Crown lawyers have also advised the tribunal that Crown facilitator Tukoroirangi Morgan has been talking to Tuhoronuku and Te Kotahitanga leaders in a bid to resolve Te Runanga o Ngapuhi and Te Kotahitanga division over settlement negotiation issues.
''The Minister for Treaty of Waitangi Negotiations [Chris Finlayson] is expecting a report from Mr Morgan of these
discussions in late July,'' lawyer Helen Carrad said. A spokesman for the minister told the Advocate that Mr Morgan was continuing to talk to the two groups and would report to the minister ''soon''.
A 225-page Crown draft concessions document released by the tribunal last week recognises the Crown breached the Treaty with land purchase policies that have left iwi in Whangarei, Whangaroa, Mahurangi and the Gulf Islands virtually landless.
The Crown concedes it took Maori ''surplus lands'' and carried out many other Treaty breaches around Northland. Historical evidence is provided to support the Crown submissions.
The Crown says Office of Treaty Settlements officials had been carefully listing Northland land losses but the record was likely to contain inaccuracies. Although the Crown could not certify the information was accurate, the data was considered sufficient grounds for making the concessions.
The draft concessions were produced following a tribunal direction in June last year, saying the Crown was not required to respond to hundreds of amended statements of claim.
"We would rather the Crown respond to both the joint claimant of generic issues and, to the extent it can, to the claimant statement of local issues," the tribunal instruction said.
The tribunal also said: "Counsel reiterate that Te Raki rangatira agreed to and signed only Te Tiriti. Accordingly, the tribunal must consider and apply Te Tiriti as the relevant document." In response to the Tiriti issue, the Crown has repeated its previous submission that it considered "te Tiriti/ the Treaty" as one document that exists in two languages.
And the Crown's draft concessions document says the tribunal's resolution of fundamental issues relating to the two versions of the Treaty need to be settled before the inquiry moves to Stage Two.
"Claimants and the Crown need to know the threshold by which the claims against the Crown are to be assessed," the Crown lawyers say. "This is for every issue and not just the issue concerning rangatiratanga, kawanatanga and autonomy."
The Crown says its position is therefore preliminary to the tribunal's report on the inquiry's Stage One hearing and the hearing of evidence on Stage Two issues.
Tribunal presiding officer Judge Craig Coxhead said in memorandum directions on Thursday that options being considered to speed up the writing of the report could include focusing all the tribunal's limited resources on producing the report.

THIS article i presented to the forum was only in the act of look how far humans are coming to after taking back their freedom. This was not, is not, and had never been about what white did and what blacks did, it was to suppose to bring out that people from all walks of life is returning freedom back to all people. People are coming back together again, besides having genetics in both irsh, english, welsch, new zealand kiwi and maori in me, i think i can safely say that it was never racist i motivated my actions, it was only to reveal what has been kept away from the worlds eyes. I felt that the world had to know thats all it was suppose to be, and the bringing back to maori form was to only uphold the dignity and respect to our people who was never giving up their right to free speech, i think it was all i intended to mean, but i see it is in the hearts and minds of all people to now start to know the difference when i mentioned what i was trying to get to.
Humanity was only suppose to bring in the awareness of how much effort they are putting into the world with love, light, compassion, divine intellectual and loving intellectual spirit into the world of form. By being one with all and the divine allness of the creator. I did not intend to separate people i was only trying to bring all human beings the awarness to all along side with all other sentient lifeforms here and from afar, that we are not going backwards anymore and to bring on the divine will so that other indigenous cultures can now start to take the helm and bring into their own self empowerment and fight for their freedom too. And not to give up. It was only to inspire and not to insult the hearts and minds and intentions all other races or to anyone person/s or culture/s or religion/s.
I am a lineage of all mixed races, so how can i be of any better or higher than any other persons. I was only addressing the hidden issues to the fore front that was all i was intending.
If it sounded harsh then i do not know how you personally felt about it. How can i know, i did not live that way, i was lucky i was raised up in australia. And yeah, some of my people like those here in australia has beaten me, but i did not care i still forgave them, even when one died i went to his grave and still forgave him for strangling me to death, yes death, but in the spirit world i was told to come back.
It is not death that frightens me it is the living that i have to worry about, so i do the best to highlight all issues no matter how frigghtening to others it maybe, sometimes to live in the light conquor your fears by letting go of the issues that you believed burned brightly from within you as you can not bring this into the higher dimensions of light and love and compassion.

the pictures of the people standing around each other holding hands is the very scene i saw all the people of the world that unites around california when it had a very nasty earthquake, and then peace happened after that and no one was above or lower then each other ever again as peace reigned in the land of america forever.
However, this dream i had was seen in my vision in 2006 on the same night the bridge collapsed that same year in america as i told people the night before, when it happened then it showed up on the news.
I got told i was the watcher i don't know what that means.
but when the people united in califonia in this dream i saw california in the shape of a huge big apple bite look when the people and citizens of all nations holding hands as they were happy yet weeping for the dead and rejoiced for the living.
Oh I so love when native cultures whose spiritual beliefs claim no one owns the earth, go to court to claim land is "theirs". Or where people who were not alive to commit atrocities are forced to pay for the actions of people who were dead 100 years before they were even born, because that is what fairness and equality are all about.
I lived in NZ for 4 years and I applaud the restorations being made to those wronged in the past. Having said that I was never totally at peace with the idea that NZ was seen as belonging to the Maori just because they may have been the first ones to settle there. We don't own the Earth we are stewards of the Earth. Also this idea that I am Maori or I am European is another very devise idea I struggle to understand. We are spirit in human form for a short time - if you get stuck in over identifying with your culture and ancestry based on your current body then you lose sight of who you really are - spirit. After all you have probably been all different races at some time in your many incarnations so don't get so hung up on I am this or they did this to me/my people. Have you considered some souls may have now incarnated as Maori to restore/understand what they did to Maori in a past life as a European settler?

As a European New Zealander I have a deep respect for the Maori culture
& feel I may have been Maori in one of my recent past lives.
I have a strong connection to some old Maori sites near here & I just love to visit them.
I was born at Long Beach in North Dunedin which has lots of amazing caves that the local Maori used,
the biggest one is large enough to live in & even has little penguins & swallows living there.
When the tide's low you can walk for miles around the coastline through all the tidal caves aswell : )
I'm pleased to see native people all around the world finally receiving recognition
& retribution for the numerous crimes against them.
We're all one big Earth family, I don't see black & white,
just one people working together to preserve our beautiful mother for all to enjoy & share : )

& many of the Maori people living there climbed down or jumped off the edge
& fell a long way into the rocky ocean below!
(when I stand up there looking down the sheer cliff I can picture what happened...)
The last time I visited I was paddling in the waves when a massive sealion came up behind me & got quite close before I turned & saw it!
(it was quite special since seals don't usually come close to shore when lots of people & dogs are around).
After being at the Mapoutahi beach my family visited the pa model at the Otago Museum
& it looks like we were being followed! : )

Jake the Musc happens in all walks of life, i hate fighting full stop, however i have seen that women have really bad tempers too, i seen from many families, the drinking does not help so much, oh boy, but on the brighter side, just keep intellectually expanding in spiritual understanding. Anyhow just because i am maori in this lifetime, i was a white man in my last life time, and i was a prick to people with money. So you become what you do and say to others in other life times, i saw this in one of my past lives in a dream state, and knew i was a selfish prick in that lifetime, but in this one i knew what selfishment does by others directed back too me, God was able to show my my errors of my ways, so if you don't like your book scrap it and re write it. You are the mighty pen that creates history all the time, be the book and no more teaching dirty looks. lol
